Ferienhausmiete.de is a project by resido e.K., Wichertstraße 14a, 10439 Berlin, Germany. It is the operator of the website ferienhausmiete.de, and is therefore responsible for the collection, processing, and use of personal data within the meaning of the Federal Data Protection Act [BDSG] and the Telemedia Act [TMG], when you visit this website and use the Platform’s features.
1. Collection and storage of personal data, and the nature and purpose of its use
a) On visiting our website
You can visit our website at www.ferienhausmiete.de without disclosing details about your identity. Your browser only sends automatic information to our website’s servers. This information is stored temporarily in a so-called log file. The following information is collected without your assistance and is stored until it is automatically deleted:
- the IP address of the requesting computer;
- the date and time of access;
- the name and URL of the file accessed;
- the website from which you access our site (Referrer URL);
- the browser you used and, where appropriate, your computer’s operating system
- the name of your Internet Access Provider.
These data are collected and processed to enable use of our website (establishing connection), to ensure system security and stability, and for the technical administration of the network infrastructure. We do not draw any conclusions about you as a person.
b) On registration on our Platform
As a Holidaymaker you can browse our Platform for offers of holiday homes and holiday flats, and make corresponding booking requests to the particular Lessor. It is not compulsory to register to do so. Registration as a Holidaymaker is voluntary and enables you to use extended features, like management of your booking requests.
As a Lessor you must register on our Platform in order to be able to offer holiday flats and holiday homes on our Platform.
In registering on our website as a Holidaymaker or Lessor, we collect and store the following data from you as compulsory details:
- first name;
- email address.
You can provide further information later voluntarily in your user account.
These details are collected and stored,
- in order to know who our Contractual Partner is;
- to establish, design the content of, execute and amend the contractual relationship with you on the use of our Platform as a registered Holidaymaker;
- to review the data entered for plausibility;
- to make contact with you if necessary
Your stored data are kept for the duration of the contractual relationship with you and then deleted.
c) On sending a request
If you are interested in a holiday flat or holiday home, you can use our enquiry form to make contact with the Lessor. For this, the following mandatory information is to be given:
- first name;
- email address;
- telephone number;
- arrival and departure dates;
- number of adult holidaymakers.
You also have the option to give further, voluntary information, and can ask questions of the Lessor.
All of the information you give is passed on to the Lessor as a contact request. The Lessor will use this information to review your request and respond to you.
If you send a request as a registered Holidaymaker, the information you give in the booking request is stored in your user account until deletion.
d) On using our contact form
You can send us general requests via the contact form on our website. It is mandatory to give your surname and a valid email address here. Further data, such as a message, can be given voluntarily.
These data are collected in order to know who a request comes from and to be able to answer it as best as possible.
e) On subscribing to our newsletter
If you have given your express consent, we use your email address to regularly send you our newsletter. At the end of each newsletter you can find a link by which you can unsubscribe from the newsletter at any time. You can also unsubscribe from the newsletter at any time by email to email@example.com.
2. Communication between Lessor and Holidaymaker
We enable direct communication between Lessor and Holidaymaker on the basis of a request, via our own email server system. The messages sent via our email server system are stored and processed on our servers.
All information sent by the Lessor or Holidaymaker via the email server system is visible to the other Party. However, this does not apply for the email addresses given by the Parties. This is not visible to the other Party for security reasons; instead we automatically replace it with a placeholder.
We recommend that you never send personal and sensitive data (e.g. credit card details, bank login or TAN details or user account login details) by email or via our email server system. Please be advised that we do not ask Lessors or Holidaymakers by email to send such data or to confirm personal details by clicking a link. Should you be unsure whether an email comes from us or a genuine Lessor or Holidaymaker, please contact us.
We can look at communication between Lessors and Holidaymakers, but only if this is necessary to guarantee the Contracting Parties’ security or a proper agency service. This is the case, for example, if Contracting Parties need to be protected against criminal offences carried out via phishing or the sending of false emails.
3. Sending personal data to third parties
If you post an Advert for a holiday home or holiday flat as a Lessor, your forename and surname, and the telephone number you have given for prospective renters are visible.
If you make contact with a Lessor as a Holidaymaker, we send the Lessor your forename, surname, and telephone number.
Otherwise, we only send your personal data to third parties if you have expressly agreed, if there is a legal obligation to do so, if sending is necessary to enforce proven legal claims from third parties and there is no reason to believe that you have an overriding interest worthy of protection in non-disclosure of your data, or if this is necessary to enforce our rights, particularly to enforce claims from the contractual relationship with you.
The cookies store information which arises in connection with the specific terminal device used. However, this does not mean that we thereby receive direct information about your identity.
Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer, or so that a notice always appears before a new cookie is stored.
However, completely deactivating cookies can prevent you being able to use all of the functions on our website.
5. Google Analytics
We use the web analysis service Google Analytics from Google Inc. (“Google”) for the purposes of needs-based design and continuous optimisation of our sites. In this context, pseudonymised usage profiles are created, and cookies (see Clause 4) used. The information generated by the cookie and any further information automatically generated about your use of this website (including your IP address) is transmitted to a Google server in the USA and stored there. IP addresses are anonymised so that it is impossible to assign them to you (IP masking). This information is used to analyse use of our website to compile reports for us on website activity and to provide further services for us related to website and Internet use. In no circumstances is your data combined with other data collected by Google.
Google only transfers the information to third parties if this is prescribed by law under domestic or foreign regulations to which Google is subject in the specific case, or if other bodies process these data on Google’s behalf.
